TERMS OF SERVICE
OVERVIEW This website is operated by Timber Mouldings Direct Limited. Throughout the site, the terms “we”, “us” and “our” refer to Timber Mouldings Direct Limited. By accessing this website and/or purchasing from us, you agree to be bound by these Terms of Service.
1. USE OF OUR WEBSITE You must not use this website for any unlawful purpose or in breach of any applicable laws.
2. GENERAL CONDITIONS We reserve the right to refuse service to anyone at any time. We may limit or cancel quantities purchased per order, per customer, or per address where necessary.
3. PRODUCTS, SERVICES & SAFE HANDLING
-
Availability: All products are subject to availability. We reserve the right to refuse or cancel any order at our discretion.
-
Natural Variations: Many of our products are machined or made to order. Timber is a natural material; variations in grain, colour, knots, and finish are standard and not considered defects.
-
Tolerances & Acclimatisation: Wood is a hygroscopic material that responds to environmental changes. We are not liable for any warping, bowing, splitting, or shrinking of timber that occurs after delivery due to poor storage, incorrect installation, or changes in humidity and temperature. Customers must allow timber to properly acclimatise to its final environment before installation. Furthermore, all machined timber is subject to standard manufacturing tolerances (typically +/- 1mm to 2mm). Minor deviations within these tolerances are not classified as defects.
-
Safe Handling: Timber products may have sharp edges, rough surfaces, or splinters. Customers must exercise due care and use appropriate Personal Protective Equipment (PPE), such as heavy-duty gloves and safety glasses, when handling, cutting, and installing our products. We are not liable for minor injuries (such as splinters or cuts) resulting from the inherent nature of the material or improper handling.
4. ORDER ACCEPTANCE & CONTRACT FORMATION When you place an order on our website, you will receive an automated acknowledgment email. This email is simply a confirmation that we have received your request; it does not constitute legal acceptance of your order. A legally binding contract between us is only formed when we dispatch the goods to you. We reserve the right to decline or cancel any order prior to dispatch for any reason, including but not limited to stock unavailability, pricing errors, or suspected fraud. If we cancel an order, a full refund will be issued immediately.
5. PRICING & ERRORS Prices may change without notice. We reserve the right to correct any errors in pricing, descriptions, or availability, including after an order has been placed.
6. RISK AND OWNERSHIP (TITLE)
-
Risk: The risk of loss, theft, or damage to the goods passes to you the moment the goods are delivered to your specified address or collected by you (or your appointed representative).
-
Ownership: Legal ownership (title) of the goods shall not pass to you until we have received payment in full (in cleared funds) for the goods and any associated delivery charges. Until ownership has passed, you hold the goods on a fiduciary basis as our bailee and must store them properly and safely.
7. DELIVERY & LEAD TIMES All dispatch and delivery timeframes are estimates only and are not guaranteed. We aim to dispatch orders within stated timeframes; however, delays may occur due to circumstances beyond our control, including:
-
Material shortages
-
Production delays
-
Machinery breakdown
-
Labour shortages
-
Courier or transport issues
Delivery timeframes apply from the date of dispatch, not the date of order. Express services prioritise order processing but are not guaranteed delivery services. We are not liable for delays once goods have been dispatched, including those caused by third-party couriers.
8. LIMITATION OF LIABILITY & WORKMANSHIP Nothing in these Terms excludes your statutory rights under UK law, nor does it exclude liability for death or personal injury caused by our proven negligence. However, to the fullest extent permitted by law:
-
Indirect Losses: We shall not be liable for any indirect or consequential losses, including loss of profits, business, or project delays.
-
Third-Party Workmanship: We accept no liability for goods that have been incorrectly cut, fitted, altered, or installed by you or any third-party tradesperson (e.g., joiners, carpenters). The responsibility for ensuring the correct application and installation of our products lies entirely with the buyer.
-
Damaged Goods: If a product is damaged in transit (e.g., cracked or broken), it must be reported to us immediately as per our Returns Policy. If you or your tradesperson choose to cut, install, or otherwise use goods that arrived damaged, we accept no liability for any subsequent injuries, structural failures, or project costs.
-
Total Liability: Our total financial liability for any claim shall not exceed the purchase price of the goods supplied.
9. FORCE MAJEURE We shall not be liable for failure or delay due to events outside our reasonable control.
